Sunbiz Paradise LLC / Sunbiz Paradise Tours LLC And Vessel

Please read and review. This is a legal binding contract.

This Agreement is made on today's date by check marking this link upon checkout confirms that you have fully read and understand the Boating Liability Release Form.

I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH BOATING, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS.

I UNDERSTAND THAT I HAVE DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO.

I assert that I am physically fit to ride on a boat and I will not hold the Sunbiz Paradise LLC, Sunbiz Paradise Tours LLC, Vessel, Owner of Vessel or its Captain, their employees, agents or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which occur while chartering the boat or otherwise participating in the trip.

I fully understand that Sunbiz Paradise LLC, Sunbiz Paradise Tours LLC, Vessel, Owner of Vessel or its Captain has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions.

Sunbiz Paradise LLC, Sunbiz Paradise Tours LLC, Vessel, Owner of Vessel or its Captain made no representations to me, implied or otherwise, that they or their crew can or will perform safe rescues or render first aid. In the event I show signs of distress or call for aid, I would like assistance and will not hold Sunbiz Paradise LLC, Sunbiz Paradise Tours LLC, Vessel, Owner of Vessel or its Captain, their crew or passengers responsible for their actions in attempting the performance or rescue of first aid.

I agree to forever discharge and release Sunbiz Paradise LLC, Sunbiz Paradise Tours LLC, Vessel, Owner(s) of Vessel or its Captain, its employees and agents, the owner(s) Sunbiz Paradise LLC, Sunbiz Paradise Tours LLC, Vessel, Owner of Vessel or its Captain, affiliates, from any and all responsibility or liability for any and all injuries or damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any NEGLIGENCE or other liability, EVEN IN CASES OF GROSS NEGLIGENCE. I further specifically agree, on behalf of myself, my heirs and assigns, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any activities with or involving the released parties.

Personal Property Risk. The Participant brings Personal Property aboard the Vessel entirely at their own risk and acknowledges that such property may be damaged, lost, stolen, or destroyed during the Activities.

No Responsibility for personal property. The Released Parties shall have no responsibility or liability for any damage, loss, theft, or destruction of the Participant's Personal Property, regardless of cause, including but not limited to negligence of the Released Parties.This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations, agreements, and understandings, whether written or oral, relating to the Participant's participation in Activities involving the Vessel.

The Participant acknowledges that they have had sufficient opportunity to review this Agreement and seek legal counsel before signing, and that no oral representations or modifications to this Agreement shall be binding unless set forth in writing and signed by both parties.

The Participant agrees to comply with all safety instructions, rules, and regulations provided by the Owner/Operator, captain, crew members, or other authorized personnel at all times while on or around the Vessel.

I am Solely responsible for Consumption of alcohol or any substances that may impair judgment or physical coordination

The parties acknowledge that they have not relied on any representations, warranties, or agreements other than those expressly set forth in this Agreement.

Bringing aboard prohibited items including weapons, fireworks, or other dangerous materials is strictly prohibited.

The Participant acknowledges that failure to follow safety rules and regulations may result in immediate removal from the Vessel and termination of participation in Activities without refund.

This Agreement is intended to be as broad and inclusive as permitted by the laws of FLORIDA and is designed to provide the Owner/Operator with protection from liability claims arising from the Participant's voluntary participation in boating activities.

PARENT/GUARDIAN CONSENT (Required if Participant is under 18 years of age)

In the event the Participant is a Minor, the parent or legal guardian executing this Agreement on behalf of the Minor provides the medical treatment authorization set forth in this Section and assumes responsibility for all associated medical expenses.

I am the parent or legal guardian of a minor/s participant. I have read this agreement and understand its terms. I give my consent for the minor to participate in boating activities and agree to be bound by all terms of this waiver on behalf of the minor.

I HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FROM THE DATE OF MY SIGNATURE, FOREVER INTO THE FUTURE.
